1. Introduction

1.3 By using LinkShortener or signing up for an account, you agree to these Terms and Conditions.

2. Definitions and Interpretation

2.1 In these Terms and Conditions, the following expressions have the following meanings:

  • “Agreement” means the agreement between the Service Provider and the Client, incorporating these Terms and Conditions, governing the provision of the Services;
  • “Business Day” means any day (other than Saturday or Sunday) on which ordinary banks are open for their full range of normal business in the United Kingdom;
  • “Client” means the party procuring the Services from the Service Provider as identified in the Agreement;
  • “Commencement Date” means the date on which provision of the Services will commence, as defined in the Agreement;
  • “Confidential Information” means, in relation to either Party, information disclosed to that Party by the other Party pursuant to or in connection with the Agreement (whether orally, in writing, or through any other medium, and whether or not the information is expressly stated to be confidential or marked as such);
  • “Fees” means any and all sums due under the Agreement from the Client to the Service Provider;
  • “Service” means the service to be provided by the Service Provider to the Client in accordance with the Agreement;
  • “Term” means the term of the Agreement as defined therein;
  • “We/Us/Our” means the Service Provider, namely Email s, trading under Email Marketing Tools Limited.

3. Information About Us

3.1 Our site, https://www.linkshortener.io, is owned and operated by EMAIL MARKETING TOOLS LIMITED, a company registered in England under 13556506, with the registered address at 153a Mortimer Street, Herne Bay, Kent, England, CT6 5HA.

4. Provision of the Services

4.1 When you sign up for an account and agree to these Terms, the Agreement between you and LinkShortener is formed, and the Term will begin. The Term will continue for as long as you have a LinkShortener account or until you or we terminate the Agreement in accordance with these Terms, whichever happens first.
4.2 If you sign up on behalf of a company or other entity, you represent and warrant that you have the authority to accept these Terms and enter into the Agreement on its behalf.
4.3 Either party may terminate the Agreement at any time and for any reason by terminating your LinkShortener account or giving notice to the other party.
4.4 We may suspend the Service to you at any time, with or without cause. If we terminate your account without cause, we will refund a prorated portion of your prepayment. No refund or reimbursement will be provided in any other situation, including if your account is suspended or terminated for cause, such as a breach or violation of the Agreement.

5. Payments

5.1 After placing an order on our website, you will need to make payment for the goods or services you have ordered. We use Stripe, a third-party payment processor, to process your payment.
5.2 Your payment will be processed by Stripe, and they will collect, use, and process your information, including payment information, in accordance with their privacy policies. You can access their privacy policy via the following link: https://stripe.com/gb/privacy. Please also refer to our Privacy and Cookies Policy.
5.3 By signing up for a Monthly Plan, you agree to monthly recurring billing, starting from the date you sign up. Billing occurs on the same day each month, based on the date you started your Monthly Plan.
5.4 If any payment under the Agreement is due on a non-Business Day, it may be made on the next following Business Day. If any part of a month is included in the Term, then payment is required for the full month.
5.5 If you use the Service under the free plan (“Free Plan”) and exceed the Free Plan limits, you must upgrade your account to, and select and pay for, a Monthly Plan.
5.6 If you have a Monthly Plan or an outstanding balance with us, you must provide valid debit or credit card (“card”) information and authorise us to deduct your charges from that card. You will replace the information for any card that expires with information for a valid one.
5.7 If your card is automatically replaced with a new card by a payment processor, you acknowledge and agree that we are authorised to deduct any charges on your account against the new card.
5.8 Anyone using a card represents and warrants that they are authorised to use that card, and that any and all charges may be billed to that card and will not be rejected.
5.9 If we are unable to process your card order, we will try to contact you by email and may suspend your account until your payment can be processed.
5.10 We may change our fees at any time by posting a new pricing structure on our LinkShortener site.

6. Rights

6.1 We own all proprietary rights in the Service.
6.2 You shall retain all right, title, and interest in and to the material, content, data, and information you submit to LinkShortener while using the Service (collectively, your “Content”).
6.3 Subject to these Terms, you grant us permission to access and use your campaign analytics only.
6.4 By granting us access to your campaign analytics, your campaign audience data may also be accessible to us; however, at no time will we access, use, distribute, or store third-party data.

7. Liability and Indemnity

7.1 To the maximum extent permitted by law, you acknowledge and agree that you assume full responsibility for any loss that results from your use of the Service, and we will not be liable for any damages under any circumstances.
7.2 You agree to indemnify and hold us harmless from any losses and expenses that directly or indirectly result from your Content, use of the Service, or third-party claims that you or someone using your account did something that, if true, would violate any of these Terms.

8. Enterprise Plan

8.1 The Enterprise Plan is designed for organisations requiring advanced usage, integrations, or custom development.
8.2 Enterprise Plan subscriptions may include higher usage limits, dedicated account management, custom integrations, and priority support.
8.3 Features, pricing, and service levels for the Enterprise Plan will be defined in a separate Service Order or Statement of Work agreed between the parties.
8.4 Unless otherwise agreed in writing, Enterprise Plan subscriptions remain subject to these Terms and Conditions.

9. Contact-Level Short Links and Integrations

9.1 Enterprise clients may generate contact-level short links through CSV import or API integrations with third-party platforms (including but not limited to email marketing platforms such as Mailchimp).
9.2 The client is solely responsible for the lawful collection, processing, and transfer of any personal data provided.
9.3 LinkShortener acts as a data processor only with respect to the generation and storage of short links and related analytics.
9.4 The client must ensure that all data provided complies with applicable data protection and privacy laws, including but not limited to GDPR, CCPA, or other relevant regulations.
9.5 We are not responsible for the performance, availability, or compliance of any third-party platforms with which our service integrates.
9.6 API and CSV imports may be subject to usage limits and fair usage restrictions as defined in the client’s subscription plan or Service Order.
9.7 The client must implement appropriate safeguards when transferring data to our systems, and we will maintain commercially reasonable security practices to protect such data in line with our Privacy and Cookies Policy.

10. Privacy

10.1 Your privacy is important to us. Please read our Privacy and Cookies Policy for information regarding how we collect, use, and disclose your personal information and the privacy rights available to you when you use and interact with the Service.

11. Complaints and Feedback

11.1 We welcome your suggestions, comments, input, or other feedback (“Feedback”) regarding the Service.
11.2 We strive to ensure that your experience with our Service is positive; however, we also want to hear from you if you have any cause for complaint.
11.3 By providing us with any Feedback, you grant us permission to use, reproduce, publicly display, and distribute the Feedback as we see fit.
11.4 Any Feedback you choose to provide is given entirely voluntarily, and we may use any Feedback you provide to improve the Service or to develop new features and services.
